By accessing and using PathCanary's synthetic monitoring platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Service Description

PathCanary provides:

• Synthetic browser monitoring for e-commerce checkout flows
• Automated testing on desktop and mobile devices
• Anomaly detection using statistical analysis
• Instant alerts with screenshots and diagnostic data
• Assisted rollback capabilities for detected issues

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access.

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Acceptable Use

4.1 Permitted Use

You may use PathCanary to:

• Monitor your own websites and applications
• Test checkout flows you have authorization to access
• Receive alerts about performance issues and failures
• Integrate with your CI/CD and incident management systems

4.2 Prohibited Use

You may NOT use PathCanary to:

• Monitor websites without proper authorization
• Conduct denial-of-service attacks or load testing that disrupts services
• Violate any laws, regulations, or third-party rights
• Attempt to access or interfere with other customers' data
• Reverse engineer or attempt to extract the Service's source code
• Use the Service to create a competing product
• Share access credentials with unauthorized parties

5. Subscription Plans and Billing

5.1 Plans

PathCanary offers Free, Starter, Pro, and Enterprise subscription plans with varying features and limits as described on our pricing page.

5.2 Payment

Paid subscriptions are billed monthly in advance. You authorize us to charge your payment method on file. All fees are non-refundable except as required by law.

5.3 Price Changes

We may change subscription prices with 30 days notice. Price changes will apply to your next billing cycle.

5.4 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of your current billing period. No refunds will be provided for partial periods.

5.5 Failed Payments

If payment fails, we may suspend or terminate your account after reasonable notice and retry attempts.

6. Service Level and Availability

6.1 Uptime

We strive for 99.9% uptime for paid plans but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

6.2 Monitoring Intervals

Monitoring frequency varies by plan. We do not guarantee that all issues will be detected immediately.

6.3 Data Storage

Monitoring data is retained according to your plan's retention period. We perform regular backups but are not liable for data loss.

7. Intellectual Property

7.1 Our Rights

PathCanary and all related trademarks, logos, and content are owned by us. You may not use our intellectual property without permission.

7.2 Your Data

You retain all rights to your monitoring configurations, test data, and results. You grant us a license to process this data solely to provide the Service.

8. Data Privacy and Security

Our collection and use of personal data is governed by our Privacy Policy. We implement industry-standard security measures including encryption, HMAC signing, and row-level security.

9. Limitations of Liability

9.1 Service "As Is"

PathCanary is provided "as is" and "as available" without warranties of any kind, express or implied.

9.2 No Liability for Damages

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, or data.

9.3 Maximum Liability

Our total liability to you for all claims is limited to the amount you paid us in the 12 months preceding the claim.

9.4 Third-Party Sites

We are not responsible for the availability, content, or practices of websites you monitor through our Service.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

11. Termination

11.1 By You

You may terminate your account at any time through your account settings or by contacting support.

11.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in harmful activities. We will provide notice when reasonable.

11.3 Effect of Termination

Upon termination, your access to the Service ends immediately. We may delete your data after 30 days unless legally required to retain it.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the European Union and Romania, without regard to conflict of law principles. Any disputes will be resolved in the courts of Romania.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PathCanary regarding the Service.
